MDC 99 leader and former St Mary's legislator Job Sikhala yesterday appeared at the Harare Magistrates Court charged with contravening sections of the immigration Act.

Sikhala (40) is alleged to have assisted a South African citizen Sharon Theresa Bester to enter Zimbabwe without a passport and made her stay at his house without the necessary documents.

Sikhala's trial failed to open yesterday and he was summoned to appear at Harare Magistrate Court Five on January 17 this year. The former legislator was served with the summons, which he duly signed at the court's police post.

Sikhala was involved in a mini-drama in the police post as he was shouting at police details demanding his passport and a Mercedes E320, which he claimed police took from him.

After his release Sikhala told journalists that he was disappointed that the State had failed to try him after spending three days in police custody.

He said police had been ordered to give him his car and passport.

"They were saying the car was used to bring Sharon to Harare which is both a lie and fiction. My passport shows that I have never been to South Africa," he said.

Meanwhile, the woman in question Bester was yesterday fined US$100 by Harare Magistrate Ms Anita Tshuma after she pleaded guilty to contravening Section 29 (1) (a) of the Immigration Act which criminalises staying in Zimbabwe without a permit.

The agreed facts are that sometime in July last year, Bester was brought from South Africa by Sikhala, Aaron Muzungu and Okkie Volschenck a South African.

They assisted her to enter the country through Beitbridge Border Post and stay at Sikhala's home in Chitungwiza until the time of her arrest.

She was arrested in the City Centre after failing to produce the necessary.
